The El Paso County Attorney’s Office brings a restricted appeal from an expunction order following M.T.’s acquittal for murder. The County Attorney argues the. trial court abused its discretion in granting the expunction, because (i) although M.T. was acquitted of murder, he was also found guilty on four counts of aggravated assault with a deadly weapon arising out of the same criminal episode, and (ii) because M.T. failed to provide notice to the State of his request for expunction.
