Rodney Milton, plaintiff, instituted suit against the County of Oakland, defend*281ant, for a violation of his employment rights secured by defendant’s merit system. Defendant filed a motion for accelerated judgment upon the basis that plaintiff had filed a workmen’s compensation claim which constituted his exclusive remedy. The trial judge granted defendant’s motion, and plaintiff appeals as a matter of right.
