This was an action on a bond for the redelivery of an automobile.

The car had been stolen from its owner. The defendant, Fred R. Etchen, obtained it from a man who professed to be a deputy marshal in Oklahoma. Defendant repaired the car at considerable expense and traded it to Sam Weinberg. The plaintiff company had insured the original owner of the car against theft and had acquired .his interest and brought an action in replevin against Sam Weinberg to recover it.
