STANLEY, District Judge.
This is an action to recover compensatory and punitive damages for alleged breach of contract. It is alleged that the plaintiff is a corporation organized and doing business under the laws of the State of North Carolina, and that the defendant is a corporation organized under the laws of the State of Illinois with its home office in Peoria, Illinois, and transacting business in North Carolina.
Jurisdiction is based on diversity of citizenship, and service of summons was made on the defendant by serving the Secretary of State of the State of North Carolina, pursuant to…
