OPINION AND ORDER
CONNER, Senior District Judge.
Plaintiff, Michael Witkowich, brings suit against Michael B. Mukasey, 1 in his official capacity as Attorney General of the United States; Benigno Reyna, in his official capacity as Director of the United States Marshals Service (“USMS”), and the USMS. Plaintiff, who has been a United States Marshal for over thirty years, alleges he was denied a promotion due to his age in violation of the Age Discrimination in Employment Act (“ADEA”), 29 U.S.C. §§ 621, et seq. Plaintiff also alleges that he suffered retaliation after filing this lawsuit.…
