This is an appeal from the order of the district court, Sweet Grass County dismissing plaintiff’s complaint for failure to state a claim upon which relief may be granted.

Plaintiff, Margaret Buttrell, filed an action based on an alleged violation of the Fair Labor Standards Act, 29 U.S.C.S. §§ 201 through 219. She alleged she had not been paid the minimum wage and had not been paid overtime as required by the statute.
