OPINION AND ORDER
EDELSTEIN, District Judge:
Defendants Donald Payden (“Payden”), Anthony Grant (“Grant”) and Eugene Coleman (“Coleman”) are charged with conspiring to violate the narcotics laws of the United States in violation of Title 21, Section 846 of the United States Code. Defendant Payden is also charged with heading a continuing criminal enterprise in violation of 21 U.S.C. § 848 and with distributing, and possessing with intent to distribute, narcotics in violation of 21 U.S.C. § 841.
