Plaintiff Securities and Exchange Commission (“SEC”) previously moved for a preliminary injunction freezing the assets of the defendants and certain related parties. Dkt. Nos. 4, 5. Among those assets was the David L. and Lynn A. Smith Irrevocable Trust U/A 8/04/04 (“Trust”), which cross-moved to lift the temporary restraining order as to the Trust. Dkt. No. 31.
