MEMORANDUM OPINION
LAMBERTH, District Judge.
This matter comes before the Court on plaintiffs Motion [29] for Partial Summary Judgment and plaintiffs Motion [38] for Sanctions. Plaintiffs motion [29] seeks summary judgment to strike defendants’ affirmative defenses of trespasser, contributory negligence, and assumption of the risk.
