*508These two cases present the same questions, and by consent they were heard together upon the record in the former, with the slight addition to the latter noted in another connection.
On December 27, 1905, the board of directors of the Merchants’ Trust Company filed the hill in the original cause against the Merchants ’ Trust Company and others, for the purpose of going into voluntary liquidation.
