In this interlocutory criminal appeal, the prosecution appeals by leave granted the circuit court’s order denying defendant John Wesley Janes’s motion to quash his bindover on the charge of owning a dangerous animal causing serious injury. See MCL 287.323(2). Although the circuit court denied Janes’s motion to quash, it also determined that the statute at issue was not a strict-liability offense, as the prosecutor contended, and it warned the prosecutor that she would have to prove at trial that Janes had a negligent criminal intent.
