Plaintiff, Luz E. Rodriguez Morales, brought this action under the Age Discrimination in Employment Act of 1967 (“ADEA”), 29 U.S.C. §§ 621-634, against the Veterans Administration (“V.A.”). The district court conducted a bench trial on the matter and found that plaintiff failed to prove that her termination was due to age discrimination. The court found that the V.A. had articulated legitimate, non-discriminatory reasons for its decision not to promote and its decision, ultimately, to terminate the plaintiffs employment.
