OPINION AND ORDER

SESSIONS, District Judge.

This is a 42 U.S.C. § 1983 civil rights action filed by plaintiff Richard Billado against Sheriff Gardner Manosh, Deputy Jeffrey Parry, and Deputy Christopher Jones, of the Lamoille County Sheriffs Department. Billado claims that when he was in the custody of Deputies Parry and Jones, he was assaulted by another man, and that the deputies failed to protect him from this assault in violation of his constitutional rights under the Eighth and Fourteenth Amendments.
