Appellant, on the 5th day of September, 1881, filed an amended complaint to set aside a default and judgment taken and rendered against him on the — day of September, 1879, the original complaint herein having been filed August 25th, 1881.

The defendants answered in five paragraphs. A demurrer was sustained to the second, and overruled to the third, fourth and fifth paragraphs, the first being a denial.

A reply was filed in two paragraphs, the first being a denial. There was a trial by the court, finding for defendants, and, over a motion for a new trial, judgment was rendered for…
