MEMORANDUM OPINION
ACKER, District Judge.
This case comes before the court on the motion of plaintiff, Shirley M. Kisor (“Ki-sor”), to remand her case to the Circuit Court of Cherokee County, Alabama, where she filed it and from which it was removed by defendants, Olin M. Collins. Jr. (“Collins”) and Millis Transfer, Inc. (“Millis”). The notice of removal filed on July 27, 2004, reflects that the state court complaint was served on the first served defendant on June 28, 2004. This means that the thirty (30) day window for removal provided by 28 U.S.C. § 1446(b) was barely met. The two removing…
