Green, J.:

Ahmad Ah Sultani and Najiba Sultani appeal from the trial court’s denial of their motion for a new trial. The Sultanis argue that the jury should have awarded noneconomic damages in this wrongful death case. The trial court determined that the Sultanis had waived their right to a new trial because they had declined to require the juiy to return to deliberations and include an award of noneconomic damages in its verdict.
