This was an action commenced within one year after the date of the accident by Orvin W. Gilliland, plaintiff (appellee), against Kansas Soya Products Company, Inc., defendant (appellant), under the provisions of G. S. 1959 Supp., 44-504, to recover damages for personal injuries sustained by plaintiff due to the negligence of the defendant. This is a companion case to Schafer v.
