OPINION

DITTER, District Judge.

This personal injury case comes before the court on defendant’s motion for summary judgment based on the fact that both plaintiffs have previously compromised identical claims with the third-party defendant.

At 6:30 on the morning of August 5, 3 968, the plaintiffs were travelling south on Route IS in Bristol Township. Pennsylvania, in a 1955 Volkswagen. Suddenly a Plymouth, driven by third-party defendant Miller, hurdled the low concrete median strip of Route 13 and struck the Volkswagen head on.
