MCLAUGHLIN, District Judge.

Plaintiff Ernestine Lee is an 84 year old woman who alleges that she was injured when she tried to board a bus operated by the defendant, the Southeastern Pennsylvania Transportation Authority (“SEPTA”). Ms. Lee alleges she was injured because the driver of the bus failed to employ a “mechanical lifting device” available to assist passengers who have difficulty boarding.
