The plaintiff herein has made a motion to dismiss the writ of error in this cause. Judgment was rendered on June 23, 1910. A writ of error was thereafter issued out of this court, and the judgment was affirmed in the case of Minkkinen v. Quincy Mining Co., 169 Mich. 279 (135 N. W. 449). On the 5th day of June, 1912, the defendant made another motion for a new trial upon grounds, set forth therein, which motion was denied by the trial judge upon the merits.
