The Agricultural Labor Relations Board of the State of California (ALRB or the Board) appeals from the district court’s summary judgment order, holding that California’s Agricultural Labor Relations Act, Cal.Lab.Code §§ 1140-1166.3 (West Supp. 1986), is preempted by the Employee Retirement Income Security Act of 1974, 29 U.S.C. §§ 1001-1461 (1982) (ERISA), to the extent that it may be applied in a way that affects employee benefit plans.
