Plaintiff in error was plaintiff and defendant in error was defendant in tbe trial court, and these designations will be used in this opinion. Plaintiff was denied recovery in a suit upon a policy of insurance designated as “employers’ liability,” and brings error.
On tbe 17th day of February, 1921, and previously, plaintiff was and bad been engaged in the'operation of a sawmill and tbe manufacture of lumber at Farrell, in tbe state of Arkansas.
