Defendant, Jim Story, was charged in the court of common pleas of Oklahoma county, with the crime of unlawful possession of intoxicating liquor, to wit, ten pints of non-taxpaid whisky, was tried before the court, having waived a jury, was convicted and sentenced to pay a fine of $50 and to’ serve 30 days in the county jail, and has appealed.

It is contended that the court erred in overruling the motion to suppress the evidence by reason of the illegality of the search warrant issued in this case.
