Defendant, below appeals from a verdict awarding respondents, plaintiffs below, $10,800 nuisance damages against appellant, Ideal Cement Company.

This is the latest in a series of actions by Riblets, respondent owners, against appellant’s predecessor, th'é Spokane-Portland Cement Company, and now against appellant. Appellant bought the plant from the' Spokane-Portland Cement Company on October 1, 1954. The first action was instituted in 1950, and a new one has been filed every two years thereafter. Riblet v.
