—Appeal from a judgment dismissing an action seeking the surrender of shares of stock standing in the names of the several individual parties to the action.

*458The real controversy in this case is the actual ownership of 1,250 shares, being one-fourth of the capital stock of the Ranke Investment Company, a corporation of the nominal capitalization of $500,000, and the actual value being approximately the same.
