Mason, J.:

E. H. Johnson appeals from a conviction upon four counts charging him with embezzling money of the Railroad Men’s Refining Company, a corporation of which he was the president.

The defendant introduced no evidence. The evidence of the state tended to show these facts: The charter of the corporation provided that its general offices should be located in El Dorado. It carried a deposit in its own name in a bank situated there. Checks upon this deposit were drawn from time to time signed with the name of the corporation by E. H. Johnson,…
