BUA, District Judge.
This cause comes before the court on the motion of defendants Victor Sebastian and Carlo Di Cicco to dismiss the complaint in light of the pendency of a similar state court action.
On October 5, 1976, plaintiffs filed an action (No. C 76-3786) in the Circuit Court of Lake County, Indiana, 1 against defendants Sebastian and Di Cicco, seeking to recover $500,000 damages for personal injuries suffered by plaintiff Robert Burrows.
