Tenant, under the agreement between the parties, went into possession of the premises and continues in possession thereof as a tenant from month to month.. None of the cases cited in landlord’s memorandum supports the view that the emergency rent laws preclude the creation by agreement of month-to-month tenancies, or that, upon such laws becoming effective, those holding under such agreements become, ipso facto, “ statutory tenants ”.
