This matter is before the Court after a three-day trial held in Seattle, Washington, from November 6-8, 2006. The Court must determine whether the parties entered into an accord and satisfaction of the claims asserted by plaintiffs in this action. Plaintiffs’ claims relate to (1) the criteria used by the Puget Sound Naval Shipyard (the “Shipyard”) to determine the circumstances under which it would pay certain Environmental Differential Pay, and (2) plaintiffs’ entitlement to back Environmental Differential Pay.
