PARRISH, Presiding Judge.

This is an appeal of a judgment entered by the circuit court after refusing to call a jury because appellant (the defendant before the trial court)1 failed to post a $500 “cost bond.” This court reverses and remands the case for a new trial.

A prior trial of this case was appealed to this court. That appeal resulted in the case being reversed and remanded for further proceedings consistent with a disputed circuit court order that had granted a motion for new trial. Grimes v.
