This is a suit for a declaratory decree under G. L. (Ter. Ed.) c. 231 A, inserted by St. 1945,' c. 582, § 1, brought by Jesse M. Stern, otherwise called Jesse Stern, to determine his rights in a written declaration of trust, called the Kendall Realty Trust, dated April 30, 1936, and recorded in the Middlesex South District registry of deeds on May 1, 1936, and described hereinafter. The plaintiff appeals from the final decree.
