The plaintiffs sued for breach of a contract to purchase five hundred barrels of Good Will flour and two hundred barrels of Seaboard Clear flour. The defendant set up in answer, in addition to a general denial, that the sale was by sample and that the goods were not up to the sample; *69that the contract, if any, was in writing and had been altered in a material particular; and that the statute of frauds had not been complied with.
