This case is now before the court on cross-motions for summary judgment of plaintiff, Harry S. Peare, and defendant-in tervenor, United States Department of Labor (DOL). The sole issue addressed in these motions is whether 26 U.S.C.A. § 3304(a)(15)(A)(i) of the Federal Unemployment Tax Act, 26 U.S.C. § 3304(a)(15)(A)(i) (§ (A)(i)), permits the defendant, Indiana Employment Security Division (IESD), to reduce the unemployment benefits of Social Security recipients whose benefits vested as the result of prior work performed for a non-base period…
