-Appellee brought this suit to recover damages for personal injuries alleged to have been sustained by his w'ife through the negligence of appellant. It was alleged, substantially, that on July 4, 1906, and for many years prior thereto, the defendant railway company, owned and operated a railroad through the city of Greenville, in Hunt County, Texas; that said railroad crossed King Street in said city, which was a public street and highway; that it was the duty of the defendant when it constructed its railroad across said street to restore said street to its former…
