This is a proceeding on behalf of the Virginia Home for Incurables and the Sheltering Arms Hospital, petitioners, against Honorable Frederick W. Coleman, judge of the Circuit Court of Hanover county, respondent, for a writ of mandamus.

The material facts set out in the petition, as to which there is no dispute, are as follows: On January 25, 1935, the Virginia Trust Company offered for probate in the Circuit Court of Hanover county, as the last will and testament of Annie L.
