This is an appeal taken by appellant on the judgment-roll.

The action was for damages growing out of alleged misrepresentations of defendant to appellant in the sale of corporate stock.

The complaint alleged that on October 8, 1906, the defendant, who was the owner of sixty shares of stock, being the entire amount subscribed for, or issued, of the capital stock of the West Coast Planing Mill Company, a corporation, offered to sell plaintiff thirty shares thereof for twenty-five hundred dollars, and with intent to defraud plaintiff, and to induce him to purchase said stock, made certain…
