There are certain prominent facts in this case, which are established by the findings, and which, as we understand it, are not controverted by the parties. These facts are :

First—-That there were two corporations, to wit: “The Eureka Lake Company,” and “The Miners’ Ditch Company, ” which were duly organized under the general incorporation laws of this State, for the purpose of supplying water for mining purposes, each of which corporations owned, in severalty, several water ditches, and the two corporations having no interests in common; but the stockholders, officers and managers of both…
