HURLEY, Senior District Judge.
Presently before the Court are two motions: a motion to dismiss the complaint and a motion for Rule 11 sanctions. Both motions are brought by defendants Valley Physical Medicine & Rehabilitation, P.C. (“Valley”), Elite Physical Medicine & Rehabilitation, P.C. (“Elite”), Universal Express, Inc. (“Universal”), Dr. Joseph Mills (“Mills”) and Dr. Pavani Tipirneni (“Tipirneni”) (collectively “Defendants”).1 For the reasons set forth below, the motion to dismiss is GRANTED in part and DENIED in part.
