MEMORANDUM OPINION AND ORDER

HOOD, District Judge.

This matter is before the Court on Defendant Lexmark International, Inc.’s (“Lexmark’s”) motions for summary judgment [Record Nos. 304 & 305]. Fully briefed, Defendant’s motions are ripe for review.
