MEMORANDUM OPINION AND ORDER

ASPEN, District Judge:

Plaintiff Michael Kasper (“Kasper”) brings this patent infringement and breach of contract action against defendant Cooper Canada Limited, Inc. (“Cooper”). Kasper is the assignee of a patent issued to his father, Dale Kasper, on a helmet and face protector apparatus commonly used in the sports of hockey and broomball (“Kasper patent”). In 1976, Margaret Kasper, thenassignee of the Kasper patent, filed suit against Cooper in federal court, charging among other things that Cooper’s Model CFG face protector apparatus infringed the Kasper patent.…
