Appeal from a judgment of the superior court for Thurs-ton county, Linn, «L, entered March 31, 1908, upon findings in favor of the plaintiff, after a trial before the court without a jury, in an action of replevin. Reversed.

This is an action for the possession of personal property, including a donkey logging engine, and certain rigging and tools in connection therewith, together with wire cable, and some other items of smaller consequence. The suit was brought by the plaintiff, Charles H. Springer, against Robert Ayer, as receiver of the effects of John H. Saunders.
