This is a companion case to United States v Brown, 13 USCMA 11, 32 CMR 11, this day decided. The two men were tried in common by the same general court-martial for the same offenses. Accused, like his cohort, was convicted as charged for attempted larceny and aggravated assault, in violation of Articles 80 and 128, Uniform Code of Military Justice, 10 USC §§ 880 and 928, respectively.
