Appeal from an order of the superior court for King county, Morris, J., entered July 3, 1905, granting a new trial, after a trial on the merits and the verdict of a jury rendered in favor of the plaintiff in an action to recover damages for ejection from a train.

— This acton was brought by the appellant ta recover from the respondent $1,950, damages for injuries alleged to have been sustained by appellant in consequence of the careless, negligent, wanton, and wrongful acts of the rer spondent, its agents, servants, and employees, in throwing off appellant from one of its passenger trains. The jury rer turned a verdict for $675, in favor of the appellant, and upon motion of the respondent, a new trial was granted by the court. Prom the order of the court granting a new trial, this appeal is prosecuted.
