Appeal from the District Court of the Seventh Judicial District of the State of Nevada, Esmeralda County; Theron Stevens, Judge. Action by the Goldfield Mohawk Mining Company, a corporation, against the Frances-Mohawk Mining and Leasing Company, a corporation. Judgment for plaintiff, and from an order overruling a motion for a new trial, defendant appeals. The facts sufficiently appear in the opinion.

This action was commenced in the District Court of Nye County, Nevada, on the 15th day of January, 1907, for the purpose' of recovering two hundred thousand dollars ($200,000) alleged damages for the violation of the terms of a written lease executed by the respondent, *492Goldfield Mohawk Mining Company, to the appellant. A motion for a change of venue was interposed and granted, removing the cause to Esmeralda County, Nevada, because the plaintiff and defendant were doing business in that county, and the alleged cause of action arose therein. -
