This was a suit by the appellee, against the appellant and one Edward D. Scuddpr, upon a certain writing obligatory, of which the following is a copy :
“ Know all men by these presents, that we, Edward D. Scudder and Frank Lin deman, are each hold and firmly bound unto Emanuel Rosenfield in the sum of one hundred dollars, for the payment of which we each severally bind ourselves, our heirs and executors, upon the conditions following, to wit: Whereas the said Edward I).
