Upon the question raised in the opinion filed by Mr. Justice Carter, as to whether this court should decide the case upon the abstract of the record or upon the transcript, my view is that this court is bound under its rule 20 to decide the case upon the abstract of the record that has been prepared by the appellant’s counsel, and agreed by the appellees’ counsel to be a correct expose of the transcript of the record by his failure to file under said rule any exception questioning its correctness.
