This is an action upon a promissory note executed on September 13, 1915', to the plaintiff for three thousand dollars. The ease was tried before a jury. Plain, tiff recovered judgment, and defendant appeals. The sole issue presented to the jury was whether or not the promissory note was paid on September 14, 1915, by a cheek of the Leslie Salt Refining Company drawn on the Bank of California for three thousand dollars. This cheek was issued by the defendant as secretary of the Salt Company, and was received by W. M. Roberts, cashier of the plaintiff. That it was deposited by him to his credit…
