Appeal from a judgment of the County Court of Albany County (Breslin, J.), rendered July 24, 2002, convicting defendant upon his plea of guilty of the crime of criminal possession of a controlled substance in the fourth degree.

Defendant was indicted and charged with criminal possession of a controlled substance in the third and fourth degrees. Prior to the commencement of a Dunaway/Mapp/Huntley hearing, defendant was offered a prison term of 41/2 to 9 years which would be withdrawn once the suppression hearing began.
