MEMORANDUM OPINION AND ORDER

GADOLA, District Judge.

Before the Court is a motion by Petitioner Germaine Tyler to vacate, set aside, or correct his sentence pursuant to 28 U.S.C. § 2255 filed April 21, 1996. Pursuant to an Order from the United States Court of Appeals for the Sixth Circuit, this Court must address whether Petitioner’s conviction was marred by ineffective assistance of trial counsel and whether Petitioner’s trial was constitutionally tainted because Petitioner’s right to counsel was violated.
