OPINION AND ORDER

GADOLA, District Judge.

Before this Court is Magistrate Judge Thomas A. Carlson’s report and recommendation that the Court deny Petitioner’s motion for the writ of habeas corpus pursuant to 28 U.S.C. § 2254 [docket entry 23] and Petitioner’s objections thereto [docket entry 24]. Inexplicably, Respondent has not filed a timely response to Petitioner’s objections. Pursuant to Local Rule 7.1(e), the Court concludes that a hearing would not aid in the disposition of this matter.
